Stolen Scrambler!

I took my Son's quad in for service at a local place
MJUSA RACING HOME PAGE

Went to pick up quad and was told some BS story that is was taken while there power was out, then they were broken into an like 7-8 quads were stolen. This place didn't even call me, just let me show up to get my unit. And they never filed a police report. When police arrived to take my report, the shop didn't mention no damage or anything else missing. Just was upset that we were pissed and wouldn't leave when ask to leave there property. Here's a picture, cant be to many out there with this type rear tire, Kenda bear claw ex.




Also here's a local forum with a thread I started. Thanks for looking and keeping a eye out. I'm not on line much so PM if any info please!

Man, I'm sorry to hear this. After reading the 7 pages on the forum you posted this guy sound like bad news. I think you should make a trip down there to let youe wife kick the crap out of the counter kid!

if its a true legit business they have insurance.. make a claim it was on there business property.

Exactly. I worked at a dealership for a few years. We never had a quad stolen when I was there, but it had happened before I started there.

We had insurance that would have paid out the customers lost plus accessories no questions asked.

thats right! find out what insurance company they have if any.. if they dont then they should pay for it anyway its law.. if they do, call there insuracne direct with police report..

Yep! B2R is exactly right. You can take your police report and contact their insurance to be paid out. If they don't have insurance, or they absolutely refuse to give you that information, I'd without hesitation file a lawsuit on the owner of the business, or the business depending on how it's structured. But I'd be collecting assets from his business one way or another to be sold to get my money.

I bet when the sheriff serves his summons for court, he'll cough up the insurance info if he has it and refuses to give it to you before hand.

I'm an a-hole who is big on integrity, and when others don't have it, I have no problem taking court action.

That's the route I would go. I hate to say it, but the chances of recovering this machine are tiny. Usually when a machine is stolen, they're stripped for parts and sold that way. It's almost impossible to identify your parts, and it actually will bring more in parts then a a whole unit. They'll just destroy the frame when they're done with it.

exactly! its a point of business, the law states they must have insurance period! if they dont there responsible if they do than insurance company will Pay.

So far no help from public media, or the Attorney General's office. BBB did respond, and said they sent the owner a e-mail. As you know lawyer's are not cheap. And this was after all a 2001 Scrambler, that's why some say it was taken and not some other the nicer units left at shop. Thinking I would not pursue this to much. I think today I'm going d/town for a complete copy of police report, then over to the court house to talk to the city prosecutor's office.

Small claims court. No lawyers, but tend to have a $3-$5K limit for how much you can win. This should be an easy case to win in that.

I took an ex-landlord through small claims court when they decided our lease or the law didn't matter. Cost like $50 to file, and I won the case, so I was award my court costs on top of the judgement amount.
