Angry HELP - Just Bought New XP and Badly Ripped Off

Hi All,
I just bought Brand New 2009 550 XP with EPS from Polaris Dealer in FL.
This ATV was listed as brand new in dealer's Web Site.
As I am in NY, I didn't visit the dealer or saw the ATV. Today I received my ATV and notised that this ATV was accidented from both front and back with badly scratched on full rear side and on front side and front bottom was painted.
I am so mad and I will
1, File a complaint to Polaris.
2, File a complaint FL department of consumer affairs.
what else can I do against that dealership?

Maybe it got damaged in shipping and they tried to cover it up? Just a thought.

Hi,
No, just recived today @ 8:00 PM. I will call them tomorrow.
The dealer e-mailed me 3 very bad and dark pictures of the ATV all from the other angles. After I fully inspected my ATV I went back to these pictures and in 1 pictures I notised that there is no Yellow Side Marker Decal and this is the place where the ATV is painted.
So, I am 100% sure that everything happend @ dealer's shop before shipment.

Wow. Good luck. Not sure about ATVs, but I know it is a huge issue if a dealership sells a car that has been damaged. A friend bought a van that had fallen off a car tranport semi. The dealer didn't disclose and lied about it. He sued them. He won but refused the money. He said he just wanted to prove a point and only accepted the cost of the vehicle as settlement.

"Small claims court" will do the job quick,Just make sure your ready for it,,,and stay on point,with facts and photo's,,,It will cost the dealer,,and they will probably try to pay out of court for damages!

Let me get this straight. You bought an ATV over the internet, viewed it from pictures that were "too dark", gave them money and never laid eyes on it? Live and learn I guess...

If they misrepresented the product - which it sounds like they probably did, then your only recourse is a lawsuit. Good luck with all that.

To HELP:
All I would say,is make sure you keep the photo's,and don't be handeling then tomuch,,,,,"Their evidence"(Finger prints) and your means of fact,, also the "Fraudulent add",,,get that add in hand and the source of printer(Newspaper adds, want adds flyer,,etc.)get the complete attached add as it is in the source, in hand. File at the local court house,good luck!

Hi All,
Thanks for your advice.

It’s not like that I bought this from e-bay with some crazy guy.
I bought this from a big Polaris Authorized dealer and I shipped through a good company. I mean if you can’t trust them what else you can do.

Anyway, just spoke with the dealer and according to the salesman, the ATV was there before him and was like this condition and don’t know what happened then I spoke to the GM and said the same thing and according to them, they lost the money in this deal so they can’t do anything about this.

I have all the proofs, ATV’s add, old picture from side e-mail to me before purchased date and all documents saying it is brand new.

Go for it Guy! Just make sure you have every peice of paper envolope's you will need etc. and present facts only,,,,this is staying on "POINT",,,just don't waver from the "Point",stay right on with the facts,and you'll be ok! And if you go to court keep your cool,and no swaring,,,:-) And stay behind the fince in the court room,not unless the judge orders you to approch the bench. Is actually somewhat easy. Make sure your on time,and don't miss a date! Lots of luck,,,,
OH and your going for (damages,and miss representation)
